As the year comes to a close, don’t forget about the New York State Department of Environmental Conservation’s (NYSDEC) Solid Waste Annual Report requirements. Businesses all across the state must submit various information about wastes received, processed, or sent out during the 2017 calendar year.

In accordance with 6 NYCRR (New York Codes, Rules and Regulations) Part 360 and/or ECL (Environmental Conservation Law) 27-2303, a wide range of industrial facilities must prepare an Annual Waste Report. These facilities include:

• Construction and Demolition Debris Processing Facilities;
• Recyclables Handling and Recovery Facilities;
• Transfer Stations;
• Used Cooking Oil Processing Facilities;
• Household Hazardous Waste Collection & Storage Facilities;
• Vehicle Dismantling Facilities;
• Waste Oil Storage, Reprocessing or Re-refining Facilities;
• Municipal Waste Combustion Facilities;
• Regulated Medical Waste Facilities;
• Landfills; and
• Waste Tire Storage Facilities

If you own or operate one of the above-listed facilities, check the DEC’s webpage to find the form necessary for your businesses operations.

All forms shall be completed and submitted to the NYSDEC by March 1st, 2018, either submitted electronically or by mail to both, respective DEC Regional office and the Central office in Albany, NY.

Failure to comply with NYSDEC annual reporting requirements is a violation of 6 NYCRR Part 360 and can result in penalty up to $7,500 per violation and an additional penalty up to $1,500 per day that the violation continues.

Submission of the completed Annual Report does not relieve you from any additional reporting responsibilities that are identified as special conditions in your 6 NYCRR Part 360 permit or that may be required for inactive or closed facilities, or other types of solid waste management facilities not referenced above.
