Did you receive a Local Law 84/133 Benchmarking Violation?
According to New York City’s Covered Buildings List for Compliance in 2019 (https://www1.nyc.gov/html/gbee/downloads/pdf/2019%20LL87%20CBL%20Final.pdf), over 15,000 buildings larger than 25,000 square feet are required to submit an Energy Efficiency Report. This is regulated under Local Law 84 and Local Law 133: Benchmarking. The regulation requires you to submit your property’s energy usage including gas, electric and possibly water for the entire year (Jan 1 through Dec 31).
If your property is on the NYC’s Covered Buildings List, you are required to submit the Annual Benchmarking report by May 1st of every year to the Department of Buildings. The report must be submitted on the web based ENERGY STAR Portfolio Manager. Once submitted, you will receive a confirmation email with a receipt of your submission. This confirmation email serves as proof that you are in compliance with Local Law 84 and Local Law 133.
What if I did not submit the report?
The letter states that if you fail to comply with the regulation, you may receive a fine up to $2,000 a year for each property.
This specific letter is a warning letter, and the next letter will most likely be a notice of violation!
