Did you receive the following letter?

“RE: Transition Requirements for Revised Part 360 Solid Waste Management Facility Regulations”

This letter pertains to all Construction and Demolition (C&D) Debris Handling and Recovery Facilities as well as Fill Material Transfer Stations.

If you have received this transition requirements letter, then you are subject to comply with the new NYSDEC Part 360 regulations. This letter is sent from the Department of Environmental Conservation to inform you that the changes to the 6 NYCRR Part 360 regulations are affecting you. The appropriate response to this letter is to recognize that you will have to modify and make changes to your facility in order to comply with the new regulations.

Important dates:

  • November 4th, 2017: The regulations are now effective. The countdown begins to when you must be in compliance.
  • May 3rd, 2019: Last day to submit a registration or permit application.

Registered Facilities to Stay Registered

If you are a registered facility and can stay registered with respect to the new rules, you must renew your registration by May 3rd, 2019. You do not have to comply with the new regulations until the renewed registration is approved.

Registered Facility to Apply For a Permit

If you are a registered facility and must apply for a permit due to the new rules, you must have submitted an approved permit application by May 3rd, 2019. You do not have to comply with the new regulations until you received your permit. Check out our previous blog on the transfer station permitting process. 

Permitted Facility to Renew their Permit

If you are a permitted facility and plan on staying permitted, you do not have to renew your permit until your original permit expires, or if you plan on making any modification or alterations to your facility. Once you receive your new permit, you must comply with the new regulations.
