An Environmental Notice Bulletin (ENB) from the New York State Department of Environmental Conservation (NYS DEC) was put forth on May 18, 2022 announcing revisions to the Part 360 Series, with minor revisions to Part 371 and Part 377. The revisions include technical amendments and clarifications to the comprehensive 2017 rulemaking due to legal and policy developments. A Negative Declaration has been prepared with supporting documents of the proposed amendments that are available on the NYS DEC’s web site with the notice here.
Public Hearings:
A legislative public hearing to receive comments on the amendments to the Part 360 Series, Part 371, and Part 377 will be held in two sessions. NYS DEC invites all persons, organizations, corporations, and governmental agencies to attend the hearing as follows:
Hearing Date: Tuesday, July 19, 2022
Times: 2:00 p.m. and 6:00 p.m. sessions
Pre-registration will be required.
Any person wishing to provide a public statement must register in advance of the hearings no later than 2 p.m. on July 18, 2022. Any person who wishes only to observe the webinar online must also register. Any person may listen to a hearing by phone without pre-registration. Comment time will be limited to 3 minutes per speaker.
Written Comments:
It is requested that oral statements also be submitted in writing. Written public comments will be accepted by NYS DEC through July 25, 2022. Written comments can be submitted by:

NYS DEC will give equal weight to written and oral statements. Since a cumulative record will be compiled, it is not required that interested parties attend the hearings.
