I Missed the NOI Deadline! What Happens Now?

The New York State Department of Environmental Conservation (NYSDEC) issued a new State Pollutant Discharge Elimination System (SPDES) Multi-Sector General Permit (MSGP) that went into effect on March 8, 2023. This new permit, GP-0-23-001, is replacing the previous permit, GP-0-17-004. GP-0-23-001 will have a five-year term.

All facilities that operate under the MSGP are required to submit an updated Notice of Intent (NOI) in order to comply with GP-0-23-001. Facilities must also update their Stormwater Pollution Prevention Plans (SWPPP) in order to remain in compliance with the MSGP.

The deadline to electronically file a NOI for your facility was June 8, 2023.

Facilities that have not obtained an updated NOI may be found to be in noncompliance with the MSGP. As a result, they may receive a Notice of Violation (NOV). Each NOV under the SPDES general permit is subject to fines of up to $37,500 per day per violation and imprisonment for up to fifteen years. NOVs can also result in the issuance of a consent order, depending on the nature and severity of the violations.
