Annual/Biennial Hazardous Waste Reports Due March 1, 2026
Certain hazardous waste generating facilities operating in New York State are required to file Annual Hazardous Waste Reports with the New York State Department of Environmental Conservation (NYSDEC) by March 1 each year in accord with the Resource Conservation and Recovery Act (RCRA).
What Information Is Included in Annual Hazardous Waste Reports?
Annual Hazardous Waste Reports include information on the generation, management, and disposal of hazardous waste by applicable hazardous waste generators within a calendar year. Annual Hazardous Waste Reports include records such as hazardous waste storage information, hazardous waste disposal manifests, and information on hazardous waste treatments, as applicable.
What Facilities Need to File Annual Hazardous Waste Reports?
If your facility meets any of the following criteria, annual hazardous waste reporting is required:
- Your facility met the definition of a Large Quantity Generator (LQG) in any one month during the calendar year.
- Your facility is considered a Treatment, Storage and/or Disposal Facility (TSDF) that treated, stored and/or disposed of hazardous waste on site during the calendar year.
- Your facility generated 15 tons or greater of hazardous waste or hazardous wastewater during the calendar year.
- The only exemption from this requirement is universal waste.
- No other exemptions or exclusions to Annual Hazardous Waste Reporting can be applied when calculating this tonnage.
What Is a Large Quantity Generator (LQG)?
A facility is a LQG if it meets the following:
- Generates 1,000 kg (2,200 lbs) or more of hazardous waste in any one calendar month, or
- Accumulates more than 1 kg (2.2 lbs) of acute hazardous waste at any time in any one calendar month, or
- Generates more than 100 kg (220 lbs) of spill cleanup material contaminated with acute hazardous waste in any one calendar month.
Are There Other Hazardous Waste Generator Categories in Addition to LQGs?
Three (3) hazardous waste generator categories have been established by the United States Environmental Protection Agency (USEPA) based on the quantities of hazardous waste produced by a facility. In addition to LQG facilities, there are two (2) other hazardous waste generator categories as follows:
- Conditionally Exempt Small Quantity Generator (CESQG):
- In any calendar month of the year, generates the following:
- ≤ 100 kg (≤ 220 lbs) of non-acute hazardous waste or hazardous waste cleanup residue, or
- ≤ 1 kg (≤ 2.2 lbs) of acute hazardous waste.
- Accumulates ≤ 1,000 kg (≤ 2,200 lbs) of non-acute hazardous waste on site at any time.
- In any calendar month of the year, generates the following:
- Small Quantity Generator (SQG):
- In any calendar month of the year, generates the following:
- > 100 kg and < 1,000 kg (> 220 lbs and < 2,200 lbs) of non-acute hazardous waste,
- ≤ 100 kg (≤ 220 lbs) of hazardous waste cleanup residue, or
- ≤ 1 kg (≤ 2.2 lbs) per month of acute waste.
- Total on-site hazardous waste accumulation is ≤ 6,000 kg (≤ 13,200 lbs), and the on-site hazardous waste accumulation time does not exceed 180 days.
- In any calendar month of the year, generates the following:
What Facilities Are Also Required to File Biennial Reports?
In addition to filing Annual Hazardous Waste Reports, LQG facilities are also required to file Biennial RCRA Hazardous Waste Reports (otherwise known as Biennial Reports) every two years.
Hazardous Waste Exempt from Reporting
Note that not every waste that may appear on a hazardous waste manifest form is categorized as hazardous in the state of New York. Non-hazardous waste or waste that is only classified as hazardous in another state should not be included in your Annual Hazardous Waste Report to the NYSDEC.

Note that, for New York State, the NYSDEC is authorized by the USEPA to carry out the federal RCRA program; however, if annual hazardous waste reports are filed online, the USEPA RCRAInfo Module should be utilized.
