The New York City Department of Housing Preservation and Development (“HPD”) is proposing to revise the rules to require certain buildings to install and utilize waste containerization systems for the management of waste generated.
Who will install and utilize waste containerization system?
Owners and/or managing agents of certain new or altered residential multiple dwellings.
Who will be affected? (Does this action apply to me?)
- Any new multiple dwelling building that contains 300 or more dwelling units,
- Any commercial building that is altered, enlarged or otherwise modified from its original physical design in order to be newly classified by the New York City Department of Buildings (“DOB”) as a multiple dwelling building that contains 300 or more dwelling units,
- Any commercial building having 50 percent or more of its floor area renovated in order to be classified by DOB as a multiple dwelling building that contains 300 or more dwelling units.
Who will be exempt?
DSNY also reserves the right to waive this mandatory requirement if it determines such waste containerization system is not operationally feasible at any time for multiple reasons.
What is the Approval of Specifications For Waste Containerization Systems?
- Storage area for waste containers should be safe, clean and odor-free at all times,
- Container Cleaning must happen on a paved surface and drained properly into a sewer or septic system that is a safe, clean, odor-free and properly operating,
- Containers should be kept on the site, if off-site, containers must not cause a nuisance to residents of the premises or of neighboring premises,
- The Department of Sanitation approves the placement of containers to ensure the location is suitable for loading and/or emptying,
