Title V Annual Emissions Reporting
Annual emissions reports for facilities holding a Title V Operating Permit in New York State are required to be submitted to the New York State Department of Environmental Conservation (NYSDEC) by April 15 for the previous calendar year.
What Is the Purpose of Title V Reporting?
Title V annual emissions reporting ensures that facilities subject to Title V permit requirements are tracking and reporting regulated air contaminant emissions accurately. These reports support statewide air planning and regulatory oversight.
Who Must Submit Title V Reports?
Facilities classified as major sources under 6 NYCRR Subpart 201-2 must complete annual reporting. Major sources are defined by a facility’s potential to emit regulated air contaminants above specified thresholds. The NYSDEC is required to collect this information by the Clean Air Act (1990). The NYSDEC’s Emission Statement regulation can be found at 6 NYCRR Subpart 202-2.
What Needs to Be Reported?
Title V facilities are required to submit:
- Annual Emission Statements documenting fuel usage and regulated pollutant emissions
- Annual and Semiannual Compliance Certifications confirming whether permit terms and conditions have been met
The Annual Emission Statement must include actual emissions data for the previous calendar year. NYSDEC generates individualized emissions statements for each registered facility.
Annual Emission Statements are due on April 15 unless a different deadline is specified in the facility’s permit.
How Do Facilities Submit Their Reports?
Facilities can submit their reports through NYSDEC’s ACE (Air Compliance and Emission) Electronic Reporting System, which allows users to:
- Upload emission statements
- Submit compliance certifications
- Access prior-year filings for reference
Facilities without ACE access must register prior to reporting.
Paper copies can still be submitted using NYSDEC forms contained in Policy DAR-11. These forms mirror the ACE reporting requirements and are accepted for facilities that do not submit electronically.
