The NYS DEC has proposed a major revision of the Part 360 Solid Waste Regulations. These rules will affect all Transfer Stations. There will be a Public Hearing on June 2, 2016, 1:00 PM at the Suffolk County Water Authority Education Center, 260 Motor Parkway, Hauppauge, NY 11788. This is the only Public Hearing to be held in the lower portion of the State. Written comments concerning the proposal must be submitted to the DEC by July 15th.
The state has held workshops throughout NYS to provide information about the proposal to the affected community.
These rules will have very limited ‘grandfather’ provisions. All fill material transfer stations currently registered to process over 250 tons/day of material will now need to obtain a NY State Permit, which involves the filing of an application and an extensive engineering report. Facilities will have 6 months after approval of the rules to file their application, and to be in compliance with the operating rules in the proposal. There will also be new requirements for tracking documents and for handling historic fill.
For C&D Facilities, there is a requirement that the receiving, processing, and sorting of mixed C&D debris must be performed within an enclosed building in order to minimize impacts on the surrounding community. Permitted C&D facilities will have to be in compliance when their existing permit is due for renewal. This means that a C&D facility must file for a permit modification with the DEC to approve the enclosure; then file with the local Building Department for a permit to construct; and then build the facility (while still operating, of course) before their current permit expires.
Waste cooking oil processing facilities will have changes made to permitting requirements as well.
