NYSDEC Waste Transporter Annual Reports Due March 1

Submitting an accurate and timely NYSDEC Annual Waste Transporter Report is a key compliance requirement for maintaining an active New York State (NYS) waste transporter registration or permit. All regulated waste transporters operating in NYS under 6 NYCRR Part 364 and Part 381 should now be preparing their annual reports that are due to the New York State Department of Environmental Conservation (NYSDEC). Annual reports must be submitted by March 1 of each year (2026) for the waste transporting activities that occurred within the preceding (2025) calendar year.

 

Is Annual Reporting Required by Regulation?

Under 6 NYCRR Part 364, there are Recordkeeping and Reporting Requirements (such as in Subpart 364-5) that state that transporters of regulated waste are required to submit an annual report to the NYSDEC by the March 1 deadline. Under Part 364, transporters are responsible for maintaining accurate records of the types and quantities (in tons) of regulated waste transported.

Similar NYSDEC reporting requirements apply for waste transporters regulated under Part 381.

 

What Information Is Required for a Waste Transporter Annual Report?

For a transporter operating with a Part 364 Registration, an annual report must include the amount of regulated waste picked up by the transporter for each applicable waste category.

For a Part 364 or Part 381 Permitted transporter, the annual report also requires information on the amount of waste transported and the receiving facility or end user for transported wastes.

All annual reports must include a signed certification in a form acceptable to the NYSDEC.

 

Are Waste Transporters Required to Be Registered or Permitted?

As per the NYS Environmental Conservation Law (ECL), any person or entity transporting regulated waste generated or disposed of within NYS is required to have a valid NYS waste transporter permit or registration.

The specific type of waste transporter permit or registration required is dependent upon the type of waste being transported, as summarized below:

NYS Part 364 Waste Transporter Registration

  • Construction and Demolition (C&D) Debris
    • Including excavated material (soil, sand, gravel, and rock)/all fill material types
  • Commercial solid waste
  • Household hazardous waste
  • Regulated medical waste (RMW)
    • May apply for limited amounts
  • Sharps

NYS Part 364 Waste Transporter Permit

  • Wastes include the following:
    • Non-hazardous commercial/industrial waste
    • Hazardous waste
    • Universal waste
    • Grease trap waste
    • Waste oil
    • Petroleum-contaminated soil
    • Oil and gas well drill cuttings
    • Oil and gas well completion or production wastes
    • Residential septage
    • Residential raw sewage including portable toilet wastes
    • Non-residential raw sewage or sewage-contaminated wastes
    • Sludge from a sewage treatment plant or water supply treatment plant
    • Regulated medical waste (RMW)
    • Waste tires
    • Asbestos

NYS Part 381 Waste Transporter Permit

  • Low-level radioactive waste (LLRW)
  • Mixed waste (LLRW mixed with hazardous waste)

Important Notes

  • There may be special requirements for waste transporter permits covering the handling of certain wastes transported in NYS.
  • Waste transporters with both permitted and registered vehicles must consolidate all information into a single annual report.
  • If a waste transporter permit or registration is not renewed, an annual report is due within 30 days following the permit or registration expiration.
  • Transporters of waste operating in New York City may be subject to further local requirements.
