NYSDEC Waste Transporter Annual Report Deadline: March 1, 2025

Annual reports for all waste transporters who operate within the State of New York under 6 NYCRR Part 364 are due to the New York State Department of Environmental Conservation (NYSDEC) by March 1, 2025.

 

What Is the Purpose of 6 NYCRR Part 364?

Part 364 is designed to protect the environment from risks associated with the mishandling and mismanagement of regulated wastes during transportation from the point of generation to an approved treatment, storage, or disposal facility. By enforcing regulations under Part 364, NYSDEC seeks to prevent both accidental and intentional waste releases into the environment, ensuring they only occur at authorized facilities.

 

Who Needs to Follow Part 364 Rules?

Part 364 applies to transporters handling various waste types, including but not limited to the following:

  • Regulated medical waste (RMW)
  • Hazardous waste
  • Commercial waste
  • Waste oil
  • Industrial-commercial waste such as construction and demolition (C&D) debris and fill material generated by commercial and industrial activities

What Are the Part 364 Permitting Requirements?

Under the New York State Environmental Conservation Law, anyone transporting regulated waste generated or disposed of within the state must have either:

  • A valid New York State Part 364 waste transporter permit
  • A valid New York State Part 364 waste transporter registration

Also note that waste transporters operating in New York City may be subject to additional requirements.

 

What Are the Part 364 Annual Reporting Requirements?

Based on Subpart 364-5 “Recordkeeping and reporting requirements,” Item c, Annual Reporting Requirement, all transporters of regulated waste are required to submit an annual report to the NYSDEC.

The annual report must include, at a minimum, a complete listing of the amount of each category of regulated waste transported and the receiving facility or user. Annual reports must be submitted to the NYSDEC by March 1 of each year for the preceding calendar year and within 30 days following the expiration of a transporter’s permit or registration if it is not renewed.

Note that transporters required to report to the NYSDEC under Part 364, or under the terms of any registration or permit issued under Part 364, must include with their report a signed certification in a form acceptable to the NYSDEC.

Transporters with both permitted and registered vehicles may consolidate the information into a single report, instead of submitting two separate reports.
