On June 7, 2023, the New York State Department of Environmental Conservation (NYSDEC) released the long-anticipated final Part 360 regulations. These regulations were initially proposed in 2017. After several rounds of public comment and many updates, they have been finalized and will go into effect next month, beginning on July 22, 2023. Under the new Part 360 rule, one of the biggest changes will be an increase in the strictness of requirements for permits and registrations that solid waste management facilities must obtain.

One important thing to keep in mind is that if your facility needs a permit under the new requirements, you will need to submit an engineering design package that has to be stamped by a NYS-licensed Professional Engineer.
