
DER-41 is a policy from the DEC’s Division of Environmental Remediation. It was created in an effort to help ensure that sufficient funding is available for remediation work. If a remediation project runs out of funds, the state is required to take it over. This places a burden on the state and its residents. By requiring those performing remediation work to provide assurance that they have the ability to finance the entire project, this should help decrease the demands put on New York State.
