If you follow Walden’s blog, you might have read our post on Tuesday about DER-41–Financial Assurance. The public comment period for this proposed policy is currently open. Originally, the last day to submit comments was September 12, 2023. However, the New York State Department of Environmental Conservation (DEC) has just announced that the public comment deadline has been pushed back to October 12, 2023.
DER-41 is a policy from the DEC’s Division of Environmental Remediation. It was created in an effort to help ensure that sufficient funding is available for remediation work. If a remediation project runs out of funds, the state is required to take it over. This places a burden on the state and its residents. By requiring those performing remediation work to provide assurance that they have the ability to finance the entire project, this should help decrease the demands put on New York State.
