The New York City Department of Sanitation (DSNY) is proposing a new amendment to rules to tighten up on trash and recycling being left on curbsides and sidewalks stating that “mountains” of bags have been attracting rats and impacting quality of life in the surrounding area. DSNY is proposing to require buildings with 150 dwelling units or more to produce a building waste management plan subject to approval by the DSNY. These plans are a step in the right direction for finding more efficient ways of disposing garbage and recycling. The department may deny collection service to any building that does not submit a waste management plan.
What Rule is Proposed?
Chapter 1 of Title 16 of the Rules of the City of New York would be amended with the addition of a new Section 1-02.2 entitled “Waste Management Plan”. DSNY is conducting a public hearing via Webex on July 20, 2021 at 9:30 am to discuss the proposed rule and accept comments from interested parties.
Who Is Impacted?
The new rule would apply to developments that are either new or at least 50% renovated (based on floor area) and are considered a multiple dwelling building. Multiple dwelling buildings are defined as buildings containing 150 or more dwelling units. The building owners or managing agents would be responsible for submitting the plan.
What Must the Plan Include?
The plan should mainly include:
- Name and contact information of the building owner or authorized agent
- Number of dwelling units
- Storage plans for 150% of the garbage, recyclables and organic waste that can be generated
- Estimated amount of garbage, recyclables and organic waste while operating at full capacity
- Plan for separation of recyclables and organic waste
- Confirmation of compliance with waste provisions related to storage space, trash chute and chute access rooms in the New York City Building Code
- Confirmation of waste containerization system
- How and where the waste will be put out for collection
