DEC Proposal to Implement Mandatory Reporting of Greenhouse Gas Emissions

The New York State Department of Environmental Conservation (NYSDEC) released a draft regulation that will require facilities and emission sources to report their greenhouse gas (GHG) emissions. The intention of this proposed Mandatory GHG Reporting Rule (6 NYCRR Part 253) is to collect data that will allow for the production of a widely available statewide GHG emission database. This proposal also hopes to streamline other air reporting and permitting requirements that facilities already comply with.

Below are sources that could be potentially required to report their GHG emissions under this reporting program, depending on the applicable emissions threshold:

  • Facilities utilized for electricity generation, stationary combustion, landfills, waste-to-energy, natural gas compressor stations, and other infrastructure
  • New York suppliers of natural gas, liquid fuels, petroleum products, liquefied/compressed natural gas, and coal
  • Concentrated animal feeding operations
  • Solid waste transporters
  • Agricultural suppliers that produce GHG emissions

DEC is developing guidance and emissions estimating tools to help facilities determine if they are subject to GHG reporting requirements.

 

How to Comment

The public comment period for this draft regulation opened on April 2, 2025, and extends through July 1, 2025. Feedback will then be reviewed by DEC before the publication of the final reporting rule, which is expected by the end of this year.

The DEC will hold public in-person hearings on the following dates:

  • DEC’s Region 7 Office on Tuesday, June 3 at 1 p.m.
  • DEC’s Central Office on Wednesday, June 4 at 1 p.m.
  • DEC’s Region 2 Office on Thursday, June 12 at 1 p.m.
