Annual Hazardous Waste Report Filing Deadline: March 1, 2024

Attention Hazardous Waste Generators and Handlers!

Do you own or operate a hazardous waste facility in New York State that meets one of the following three (3) conditions?

  1. Your facility is defined as a Large Quantity Generator (LQG) during any time in a calendar year,
  2. Your facility treated, stored, or disposed of hazardous waste on-site during a calendar year, or
  3. Your facility generated 15 tons or greater of hazardous waste or hazardous wastewater during a calendar year.

If the answer to the above question was yes for any of the three (3) listed conditions, an Annual Hazardous Waste Report must be completed and filed for your facility with the New York State Department of Environmental Conservation (NYSDEC) annually, for each calendar year, by March 1.

*Please note that the NYSDEC is authorized to carry out the Resource Conservation and Recovery Act (RCRA) program for New York State in the place of the United States Environmental Protection Agency (EPA).

 

How do I know if my facility is defined as a Large Quantity Generator?

There are three (3) Hazardous Waste Generator categories, but only those who meet the LQG criteria are required to submit annual reports to the NYSDEC.

The three (3) Hazardous Waste Generator categories are as follows:

Conditionally Exempt Small Quantity Generator (CESQG):

  • In any calendar month of the year, generates the following:
    • ≤ 100 kilograms (kg) [≤ 220 pounds (lb.)] of non-acute hazardous waste or hazardous waste cleanup residue, or
    • ≤ 1 kg (≤ 2.2 lb.) of acute hazardous waste.
  • Accumulates ≤ 1,000 kg (≤ 2,200 lb.) of non-acute hazardous waste on site at any time.

Small Quantity Generator (SQG):

  • In any calendar month of the year, generates the following:
    • > 100 kg and < 1,000 kg (> 220 lb. and < 2,200 lb.) of non-acute hazardous waste,
    • ≤ 100 kg (≤ 220 lb.) of hazardous waste cleanup residue, or
    • ≤ 1 kg (2.2 lb.) per month of acute waste.
  • Total on-site hazardous waste accumulation is ≤ 6,000 kg (≤ 13,200 lb.), and the on-site hazardous waste accumulation time does not exceed 180 days.

Large Quantity Generator (LQG):

  • Generates 1,000 kg (2,200 lb.) or more of hazardous waste in any one calendar month, or
  • Accumulates more than 1 kg (2.2 lb.) of acute hazardous waste at any time in any one calendar month, or
  • Generates more than 100 kg (220 lb.) of spill clean-up material contaminated with acute hazardous waste in any one calendar month.

**It should be noted that acute hazardous waste is defined as hazardous waste meeting the listing criteria in 6 NYCRR Part 371.2(b)(1)(ii). These acute hazardous wastes are then listed in Part 371.4(b) with the assigned hazard code of (H), or listed in Part 371.4(d)(5) (for example F-listed wastes such as F020, F021, F022, F023, F026, F027, or any waste code beginning with P0, P1, or P2).

A distinct report is required for each site location (i.e., site with an EPA ID number).
