Has your facility been inspected by the Nassau County Department of Health (NCDH)? Since January 1, 2017, NCDH has been in charge of regulating petroleum bulk storage (PBS) at all sites in Nassau County. This was previously regulated by the Nassau County Fire Marshal (NCFM). Since taking responsibility for gasoline and diesel tank storage, NCDH has been completing inspections of facilities with registered tanks to check on the on-site compliance. The most common warning/violation Walden has heard cited is the lack of a designated Class A, B, or C Operator. New York State Department of Environmental Conservation (NYSDEC) established the Operator requirements in October 2015, allowing all facilities to get proper certificates and designate Class A/B/C Operators for their location by October 2016. Understand the operator designations to avoid a Class A Operator Violation, or similar operator violation:
Class A Operator
The Class A Operator has primary responsibility for operation and maintenance of UST systems and their overall compliance. Designated Class A Operators must pass the NYSDEC Class A or Class A/B Operator exam in order to be certified.
Class B Operator
The Class B Operator (can also be the Class A Operator) has day to day responsibility for implementing requirements to keep the UST system in compliance. Designated Class B Operators must pass the NYSDEC Class B or Class A/B Operator exam in order to be certified.
Class C Operator
The Class C Operator is primarily responsible for initial response to emergencies in the event of a spill or a release from the UST system. There is no exam for Class C Operators. Class C Operators must be trained and assessed under the direction of a certified Class A or Class B Operator.
Class A/B/C Operator
An individual can serve as the Class A, Class B, and Class C Operator by passing the Class A/B Operator exam and understanding the responsibilities of Class C Operators.
