Solid Waste Annual Reports Due March 1

You may have already received an email notice from the New York State Department of Environmental Conservation (NYSDEC), Bureau of Solid Waste Management that your 2025 Solid Waste Management Facility (SWMF) Annual Reports are due no later than March 1, 2026. If you haven’t already filed, this is your reminder.

 

Is my facility is required to file an annual report?

Registered and permitted SWMFs, which are regulated by the NYSDEC under 6 NYCRR (New York Codes, Rules, and Regulations) Part 360 and/or Part 361, are required to file annual reports.

See the list below for some types of SWMFs that require annual report filing:

Recycling of Organics

  • Anaerobic Digestion
  • Animal Feed Production
  • Composting
  • Land Application
  • Mulch
  • Other Organics Recycling
  • Storage

Material Recovery

  • Construction and Demolition (C&D) Debris Handling and Recovery
  • Recyclables Handling and Recovery
  • Scrap Metal Processor
  • Used Cooking Oil/Yellow Grease Processor
  • Vehicle Dismantler
  • Waste Tire Handling and Recovery

Landfills

  • C&D Debris Landfill
  • Land Clearing Debris Landfill
  • Long Island Landfill
  • Municipal Solid Waste (MSW), Industrial or Ash Landfill

Combustion, Thermal Treatment, Transfer and Collection

  • Combustion and Thermal Treatment
  • Household Hazardous Waste Collection
  • MSW Processor
  • Regulated Medical Waste
  • Transfer Facility

Please note that if your facility handles/processes multiple types of waste materials, annual reporting may require filing multiple different report forms, depending on the facility type(s).
