Reminder: 2025 Right to Know Tier II Filing Period
If you recently received an email from the New York City (NYC) Department of Environmental Protection (DEP) Right-to-Know (RTK) Program [DEPRTK@dep.nyc.gov] with the subject, “Reminder: 2025 Right to Know Tier II Filing Period,” or something similar, please note the following:
What is the purpose of the email?
This email was sent to you as a reminder to file your 2025 Annual Facility Inventory Report (Tier II Report) with the NYC DEP by March 1, 2026.
Why was this email sent to my email address?
Your email address is attached to a NYC DEP Tier II Filing System account for a facility that had a Tier II Report submitted in a previous year.
What is an Annual Facility Inventory Report (Tier II Report)?
An Annual Facility Tier II Report details the quantity, location, and chemical nature of every hazardous substance stored within a facility. The Annual Tier II Report additionally includes Safety Data Sheets (SDSs) for each hazardous substance reported. This annual reporting is required by regulation for the purpose of emergency response preparedness.
How do I know if I need to file for 2025?
An Annual Facility Tier II Report must be filed with the NYC DEP for any facility located within the five boroughs of NYC that handles and stores hazardous substances.
What if my facility closed in 2025?
The 2025 Tier II Report covers the period from January 1 to December 31, 2025. If hazardous substances were stored at your facility at any time within this period, you need to file. You can file for an exemption from annual reporting for the following calendar year with the NYC DEP.
What happens if I don’t file on time?
Whether your facility is up to date with filing Annual Tier II Reports or this is your first time hearing about Tier II RTK reporting, it is important to get your filing completed by March 1. Your facility may be inspected by the NYC DEP and could receive a violation and/or fine if you do not complete your filing on time or at all.
Where does the Annual Tier II Report get filed?
Along with filing with the NYC DEP, you need to send Annual RTK Tier II Report filing packages to the NYC Fire Department (FDNY) and New York (NY) State Emergency Response Commission (SERC) to finalize your Annual NYC DEP RTK filing.
If it is determined that your facility stores Extremely Hazardous Substances, you will also be required to develop and submit a Risk Management Plan for each applicable substance to the NYC DEP, FDNY, and NY SERC.
