Deadline for Annual Hazardous Waste Report Filing: March 1, 2025

Annual hazardous waste reports must be filed with the New York State Department of Environmental Conservation (NYSDEC) by March 1 each year for hazardous waste generating facilities operating in New York State.

 

What Facilities Need to File an Annual Hazardous Waste Report?

An annual hazardous waste report is required if your facility meets any of the following criteria:

  • A large quantity generator (LQG) in any month during the calendar year. This includes facilities that:
    • Generated 1,000 kg (2,200 lbs) or more of hazardous waste,
    • Accumulated at any time more than 1 kg (2.2 lbs) of acute hazardous waste, or
    • Generated more than 100 kg (220 lbs) of spill cleanup material contaminated with acute hazardous waste.
  • Your facility treated, stored, or disposed of hazardous waste on site during the calendar year.
  • Your facility generated 15 tons or greater of hazardous waste or hazardous wastewater during the calendar year. Only universal waste is exempt from this requirement. No other exemptions or exclusions to annual hazardous waste reporting can be applied when calculating this tonnage.

 

Requirements for the Annual Hazardous Waste Report

If you determine that your facility is required to file an annual hazardous waste report by the upcoming March 1, 2025 deadline, your hazardous waste information for your facility for the calendar year of 2024 should be collected. This includes records such as your storage, treatments, and manifests for disposal.

 

How Do I Know What Category of Hazardous Waste Generator Applies for My Facility?

The United States Environmental Protection Agency (USEPA) established three categories of generators based on the waste amounts produced:

  • Conditionally Exempt Small Quantity Generators (CESQGs):
    • In any calendar month of the year, generates the following:
      • ≤ 100 kg (≤ 220 lbs) of non-acute hazardous waste or hazardous waste cleanup residue, or
      • ≤ 1 kg (≤ 2.2 lbs) of acute hazardous waste.
    • Accumulates ≤ 1,000 kg (≤ 2,200 lbs) of non-acute hazardous waste on site at any time.
  • Small Quantity Generators (SQGs):
    • In any calendar month of the year, generates the following:
      • > 100 kg and < 1,000 kg (> 220 lbs and < 2,200 lbs) of non-acute hazardous waste,
      • ≤ 100 kg (≤ 220 lbs) of hazardous waste cleanup residue, or
      • ≤ 1 kg (≤ 2.2 lbs) per month of acute waste.
    • Total on-site hazardous waste accumulation is ≤ 6,000 kg (≤ 13,200 lbs), and the on-site hazardous waste accumulation time does not exceed 180 days.
  • Large Quantity Generators (LQGs):
    • Generates 1,000 kg (2,200 lbs) or more of hazardous waste in any one calendar month,
    • Accumulates more than 1 kg (2.2 lbs) of acute hazardous waste at any time in any one calendar month, or
    • Generates more than 100 kg (220 lbs) of spill cleanup material contaminated with acute hazardous waste in any one calendar month.
