MULCH NOW REGULATED UNDER PART 361

Did you know that as part of new Part 361 regulations, if you require a:

  • Registration; you must have submitted the application by May 4, 2018.
  • Permit; you must apply by November 4, 2018.

These facilities must address storm water. Right now both registrations and permits will require run on/run off plans to control storm water and minimizing the movement of organics into soil. These are to be submitted with the applications. Additional changes to the Part 360 regulations are expected from the NYSDEC by the end of the year for comment and may include groundwater monitoring.

Permitted: Greater than 25,000 cubic yards of material stored at any one time (including storage of incoming material and processed material).

Registered: Between 10,000 and 25,000 cubic yards of material total stored on-site at any one time.

Exempt: Less than 10,000 cubic yards of material total stored on-site at any one time.

Operational Requirements

  • Piles must not exceed 25 feet high and 30 feet wide at the base.
  • In Nassau and Suffolk counties, piles must not exceed 15 feet high and 30 feet wide.
  • Temperature must be kept below 140 °F
  • Piles must be separated by at least 10 feet
  • Storage Limit: 180 days unprocessed and primary grind, 90 days fine/double grind
