These facilities must address storm water. Right now both registrations and permits will require run on/run off plans to control storm water and minimizing the movement of organics into soil. These are to be submitted with the applications. Additional changes to the Part 360 regulations are expected from the NYSDEC by the end of the year for comment and may include groundwater monitoring.
Permitted: Greater than 25,000 cubic yards of material stored at any one time (including storage of incoming material and processed material).
Registered: Between 10,000 and 25,000 cubic yards of material total stored on-site at any one time.
Exempt: Less than 10,000 cubic yards of material total stored on-site at any one time.
