NYSDEC Part 360

The deadline for filing Part 360/361 Solid Waste Management Facility and Organics Recycling Annual Reports for 2020 with the New York State Department of Environmental Conservation (NYSDEC) is fast approaching. All annual reports must be submitted by March 1, 2021 to both the Central NYSDEC Office in Albany New York as well the Division of Materials Management in your respective NYSDEC Region.

What facilities must file?

The NYSDEC requires annual reporting to be submitted for various materials management facilities. Below is a list of all solid waste management facilities that have a designated annual report form specific to their operation.

  • Landfills
  • Combustion and Thermal Treatment Facilities
  • Household Hazardous Waste Collection Facilities
  • Municipal Solid Waste Processing Facility
  • Regulated Medical Waste Facility
  • Transfer Facilities
  • Anaerobic Digester Facilities
  • Biosolids Composting and Other Processing Facilities
  • Composting (Yard and/or Source Separated Organic Waste) Facilities
  • Mulch Processing Facilities
  • Biosolids Land Application
  • Septage Land Application
  • Unrecognizable Food Processing Waste Land Application
  • Storage Facilities
  • Septage Storage Facilities
  • Food Processing Waste and Manure Storage Facilities
  • Recognizable Food Processing Waste Storage Facilities
  • Construction and Demolition Handling and Recovery Facilities
  • Recyclable Handling and Recovery Facilities
  • Scrap Metal Processing Facilities
  • Used Cooking Oil/Yellow Grease Processing Facilities
  • Vehicle Dismantling Facilities
  • Waste Tire Handling and Recovery Facilities

Are there Penalties for Not Filing or Filing Late?

If you do not to file an annual report with the NYSDEC for your permitted/registered facility, or you file late, your facility may be issued a violation that can result up to a $7,500 penalty per violation, and an additional $1,500 penalty for each day the violation is not resolved. A Notice of Violation often comes with an Order on Consent that has terms the facility additionally has to comply with. The NYSDEC can also take action to revoke your permit/registration for non-compliance.

Are there fees that go with your annual report?

Unlike other annual report filings required for various regulatory facilities, there are no fees due to the NYSDEC associated with annual report filings.

How do I file an annual report with the NYSDEC?

The NYSDEC provides solid waste management facility and organics recycling facility annual report forms, depending on your facility type, that must be completed and submitted (mailed in or emailed) on time. Whether your facility has a Part 360/361 registration or a permit, you must record and document all waste that was received, recovered for reuse, disposed, and transported throughout the duration of the 2020. You must also record any unauthorized solid waste that was received.
